1. Introduction
These Terms and Conditions ("Terms") govern your purchase of and access to digital products and guides ("the Product") offered by Global South Freelancers ("we," "us," or "our"). By purchasing the Product, you ("you" or "the User") agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not proceed with the purchase.
1.2. Your access and use of the Service constitutes your agreement to be bound by these Terms, which establish a legally binding contractual relationship between you and the Company. For this reason, PLEASE READ THE TERMS CAREFULLY BEFORE USING THE SERVICE.
2. Eligibility
2.1. In order to use certain features of the Service, you may need to register an account ("Account") and provide certain information about yourself as prompted by the registration form.
2.2. If you register an Account, you represent and warrant to the Company that: (i) all required registration information you submit is truthful and accurate; (ii) you will maintain the accuracy of such information; and (iii) your use of the Service does not violate any applicable law or regulation or these Terms. Otherwise, the Service may not operate correctly, and we may not be able to contact you with important notices.
2.3. The Service is not intended to be used by individuals under age of 16. You hereby represent and warrant to the Company that you meet the foregoing qualification. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Service. If you are a minor, you must have your parent or guardian read and agree to these Terms prior to you using the Service.
2.4. The Company reserves the right to suspend or terminate your Account, or your access to the Service, with or without notice to you, in the event that you breach these Terms.
2.5. You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account. You agree to immediately notify the Company of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security. The Company cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.
3. Service
3.1. When you use the Service, you represent and warrant to the Company that: (i) all required information you submit is truthful and accurate; (ii) your use of the Service does not violate any applicable law or regulation or these Terms.
3.2. The Company reserves the right to suspend or terminate your use of Service, or your access to the Service, in the event that you breach these Terms.
3.3. The Service may be modified, updated, interrupted or suspended at any time without notice to you or our liability.
3.4. You are solely responsible for obtaining the equipment and telecommunication services necessary to access the Service, and all fees associated therewith (such as computing devices and Internet service provider and airtime charges).
3.5. We retain the right to implement any changes to the Service (whether to free or paid features) at any time, with or without notice. You acknowledge that a variety of Company's actions may impair or prevent you from accessing the Service at certain times and/or in the same way, for limited periods or permanently, and agree that the Company has no responsibility or liability as a result of any such actions or results, including, without limitation, for the deletion of, or failure to make available to you, any content or services.
3.6. Your access to and use of the Service is at your own risk. To the extent permitted by law, еhe Company will have no responsibility for any harm to your computing system, loss of data, or other harm to you or any third party, including, without limitation, any bodily harm, that results from your access to or use of the Service, or reliance on any information or advice.
3.7. The Company has no obligation to provide you with customer support of any kind. However, the Company may provide you with customer support from time to time, at the Company's sole discretion.
4. Payment & Refund Policy
Due to the digital nature of the Product, which is made available to you in full immediately upon purchase, all sales are final and non-refundable. We have priced the Product affordably and designed it to provide immediate, actionable value. This no-refund policy is in place to protect our intellectual property and ensures we can continue to offer high-quality, accessible resources to our community of serious students.
5. Intellectual Property
All content within the Product, including but not limited to text, graphics, designs, templates, videos, and any other materials, is the exclusive property of Global South Freelancers and is protected by international copyright and intellectual property laws. You are strictly prohibited from copying, reproducing, modifying, distributing, creating derivative works from, or publicly displaying any part of the Product without our prior written permission. The Product is for your personal education and is not sold with Private Label Rights (PLR); you may not resell it as your own under any circumstances.
6. User Responsibilities & Code of Conduct
You agree to use the Product lawfully and for its intended educational purpose. You will not engage in any activity that is abusive, harassing, fraudulent, or that infringes upon our intellectual property rights as outlined in Section 5.
7. Modifications & Availability
We reserve the right to modify, update, or discontinue the Product or any part of it at any time without prior notice. While we strive to ensure consistent access, we are not liable for any temporary or permanent unavailability of the Product.
8. No Professional Advice; Earnings Disclaimer
The Product provides educational and informational content only. It does not constitute professional, financial, or legal advice. Your results from applying the information are dependent on your personal effort, skills, economic conditions, and a multitude of other factors. We do not guarantee any specific earnings, business growth, or client acquisition as a result of using this Product. Any testimonials or examples shown are exceptional results and are not intended to represent or guarantee that anyone will achieve the same or similar results.
9. Limitation of Liability
To the fullest extent permitted by law, Global South Freelancers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use or inability to use the Product.
10. Termination
We reserve the right to terminate or suspend your access to the Product immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Product will cease immediately, and you must destroy any downloaded materials in your possession.
11. Governing Law & Dispute Resolution
We believe in resolving issues amicably. If a dispute arises, you agree to contact us first at support@globalsouthfreelancers.com to attempt to resolve it through good-faith negotiation. If a dispute cannot be resolved through direct negotiation, these Terms shall be governed by and construed in accordance with the laws of Washington State, USA, without regard to its conflict of law provisions. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Washington State.
12. Force Majeure
We shall not be held liable for any failure or delay in performance of our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, government regulations, natural disasters, or infrastructure failures.
